After concluding the public interest investigation, I forwarded my Interim Report to the Commissioner who responded to my recommendations in his Commissioner's Notice. After considering the Commissioner's comments, I have now prepared this, my Final Report.

Brunswick News Inc. has used a little-known legal procedure to allow the search of a home of a former newspaper publisher to try to ensure he doesn't use confidential information to start his own publication.
William Kenneth Langdon resigned as publisher of the Woodstock Bugle-Observer on Sept. 19 and has since opened the office of the Carleton Free Press, which is expected to launch its first issue in November.
In his resignation letter, which he has filed with the court, Langdon cited harassment by Brunswick News vice-president Victor Mlodecki and disillusionment with company management practices that included orders to drive Irving's competitors out of business as key factors in his decision to step away from the company where he had worked for more than a decade.
Brunswick News, which is owned by J.K. Irving, initially sought an injunction to stop Langdon from starting a new publication in Woodstock but last week withdrew that request in a Saint John court.
Now Brunswick News is asking the court to issue an order preventing Langdon from approaching Bugle customers, advertisers and employees on behalf of his new paper.
As part of the request, Irving's legal team asked Justice Peter Glennie to issue an Anton Piller order.

This hole is in the fence that surrounds the York Street Train Station. I checked at 8:30 this evening (Monday, Oct.09, 2007) and the 2 holes have not been repaired by the owner, J.D. Irving Ltd.
These holes are large enough to walk through without even bending over. Someone has also cleanly removed the locks to 3 doors of the Station and they are wide open for anyone to enter the building.
I contacted the Fredericton Police Department tonight and told Corporal Randy Riley of the immediate safety hazard that this poises to the public, especially to children who will venture through the fence and walk into the building. I told Corporal Riley that the floor boards in the main section of the Station are visibly deteriorated and the floor would likely collapse under the weight of a child, seriously injuring the person if they fell into the basement underneath. I asked the Police if they would immediately contact the owner, J.D. Irving Ltd. The Police will patrol near the Station this evening but Corporal Riley said that they can’t contact the owner.
The Police Department told me that I would have to contact the Bylaw Enforcement Officer at the City of Fredericton.
For the record, a photographer for The Daily Gleaner and Tim Scammel (Chair, Friends of the Fredericton Railway) discovered the holes and the unlocked doors on October 9th during the Gleaner’s photo-shoot of the Station. I was surprised that none of these serious safety hazards were featured in the front-page story of the Station in today’s edition of the Gleaner.
J.D. Irving Ltd. must now be aware of this serious safety risk to children in our neighbourhood. The Gleaner’s pictures would have been forwarded to J.D. Irving Ltd. Both the York Street Train Station and The Daily Gleaner are owned by the Irving Group of companies.
If a member of the public created a safety hazard for children, you can bet the Police would put a stop to it immediately.
I will contact the Bylaw officer in the morning but the past several years does not give me any hope of any action. If the City does not force J.D. Irving Ltd. officials to close this hole in the fence tomorrow, the public will have to do it.
This is no longer just about heritage. The most important and fundamental mandate that City Officials and the Police Department have is to keep the public safe. I am appalled by their inaction.

Former publisher says Irving stifling his attempt to start a newspaper

A former newspaper executive with Brunswick News Inc. in western New Brunswick says the company is trying to prevent him from starting a competing title in Woodstock.
In court documents obtained by CBC News, Brunswick News alleges William Kenneth Langdon is using confidential information he obtained as one of their publishers to establish his own newspaper in direct competition with the Woodstock Bugle-Observer.
Langdon resigned on Sept. 19 after working as publisher of the Bugle-Observer for four years. He worked for Brunswick News, which is owned by J.D. Irving Ltd., for 10 years.
Brunswick News initially sought an injunction to stop Langdon from starting a new publication in Woodstock but last week withdrew that request in a Saint John court.
Now Brunswick News is asking the court to issue an order preventing Langdon from approaching Bugle customers, advertisers and employees on behalf of his new paper.
Langdon's office, home and vehicle were searched on Sept. 27 by court order. Several Bugle-related documents including cash flow breakdowns, advertising rate analysis, income statements, flyer routes and a resumé were seized.
In an affidavit, Langdon states the seized documents were material he brought home in the evenings for further review while working as publisher at the Bugle-Observer and have no value to starting a new newspaper.
