ASHLEY SMITH - WAS HER DEATH CAUSE BY THE NEW BRUNSWICK JUSTICE SYSTEM????

I have been watching the case of Ashley Smith very closely.

Now? This woman died in a lonely cell in Ontario at a young age of 19 years old!!!

The Staff claim she had an attitude problem toward the prison staff.

Ok....I’m going to change this blog to me..me...me....

Lets go back to my arrest in Saint John last year.

My first appearance in court was a very strange one.

I told the Judge that I didn’t understand the reason I was being charge?

The Judge asked me if duty Counsel chatted with me???

I said - No your honor!

I don’t know why I’m here??

The Judge ordered a recess and this old lady in a very rude manner ordered me into a small room.

I asked for my friend Tim Smith to be there as a witness but she refuse.

Minutes later, Tim showed up and we both couldn’t believe what we were hearing???

The woman read the whole charge and in a very rude manner told me that I didn’t have the right to a lawyer.

It was a misdemeanor so therefore if I'm found guilty? I won’t land in jail.

A person who’s charge by the police for an obstruction charge will surely be found guilty in a court of law.

Ok....lets say that the Iron Horse Harold Doherty would have never stepped forward?

Lets say that I would have been force to represent myself on a false charge laid by the Saint John Police Force?

I would have been found guilty and put on probation!

I would have been furious that cops who made up these charges would have won their case.

They would have went home happy and Charles would have been on probation.

Being Charles, I would have soon broke that probation and land in jail!

Once behind the walls, I would have definitely an attitude problem so therefore I would have gotten in trouble with the Prison staff.

I might have said enough is enough and punch someone in the face?

Now? The staff would have charge me with assault and tell the public and a judge that I have a behavior problem because of my ADHD!

My length in prison would have increase and I may have ended in jail somewhere in Canada for years.

All this because the Justice System didn’t grant me a lawyer in the first place.

So? I’m asking the question?

How many people such as Ashley Smith have died in prison because the Government refuse to grant them a proper lawyer because the first charge was just a misdemeanor?

I believe that our Legal Aid system must change as soon as possible before more people dies in a lonely cell outside of this Province.

It’s very sad indeed and Premier Shawn Graham must act on this issue as soon as possible.

I will have much more to blog about my arrest in Saint John once the R.C.M.P. have completed their investigation!

This is very scary stuff and only a public inquiry can get the answers and this is something I will pursue till the end of time!!!!

There are people in jail who shouldn’t be there because of a poor justice system!!!!

Ashley Smith's death must not be in vain!!!

I will not let this emotional blog change into an anti-Charles LeBlanc blog.

I'm stating the facts!!!

I wrote the story of what happen to me and could have happened?

The first issue I told the media after the verdict was - I wish you people would cover the issue that I had no right to a lawyer?

But nothing was said.

This is a very serious issue.

The Saint John Police Force are forcing the people on the ground and if they resist?

They are charge with resisting arrest and have no right to a lawyer!!!

Kelly Lamrock once told me that our legal Aid system is the worse in Canada!

Well? Now he's in power? He should do something about it.

It takes an awful Cold Hearted Person let another Die in this manner which has nothing to do with Crime but to have control over another! These sick Inhuman Goverment Trained particles of Human Waste should be Tried and Hung as what has happened is nothing more than Murder!
Charles You are right the Legal system is just as corrupt and dont think a Legal Aid Lawyer will save You,nothing could be further from the truth and on top of that thier not paid enough according to them to represent a Person in any sort of legal trouble properly ! The Police,Judges,Lawyers Prison Guards etc, etc,feed on Ignorance of the Law just like a bunch of crows on a carcas!
Remember when the Rotten Apples are on Top how are the good ones underneath ever to climb out without being spoiled along the way!
These People Practice Law on Us,They dont follow it!

Its up to the people to sue these Corrupt Officials to the point that thier insurance wont cover them any longer only then will they change! Trying to get these People criminally convicted in THIER courts is next to impossible! Watch how this gets covered up in the months to follow!

Good point but here in New Brunswick?

We don't sue the Government or the Irvings because if a lawyer wish to make a living?

He cannot go against his Boss.

This is the reason that the Irvings have hired most of the high profile lawyers in this Province.

Look at my case for one second? If it would have been in the States? I would have been surrounded by hundreds of lawyers.

Her death will not be forgotten because this blogger will make certain that this issue is confronted head on by the Government.

The poor who being sent to jails across this country because the Government refuse to grant them a lawyer.

A cop can lie on the stand and that person face certain death!!!

This is very scary stuff!!!

But what do I know? I'm just a blogger.

I can't wait for that investigation of the Saint John Police Force to be completed.

My lawyer will unlock my cage and this pittbull will be free!!!!

Thats why common people have to start studying law and looking at it for what it really is! A person in segragation after long periods start hallucinating,therefore it sets off a cycle that the Guards are in control of,they went too far and murdered her,and they probably didnt have to lift a finger to do it!
When Canads Finest start Murdering People in Airports with Tasers and a long string of other incidents I somehow dont really care anymore when a law enforcement official bites the dust during an arrest or some other incident,since I am no longer certain that they might not be the cure but maybe the cause?

If you put a person in a cage and poke it with a stick and relentlessly torture it when it comes out a animal and bites you back who is to blame?

First of all, you CAN'T reproduce newscast pictures on your blog. It's illegal 'cause of Copyright laws, which obviously don't apply to you.
Second, I think the Saint John police force should have handed you coffee, donuts, soups and why not, a full meal from a nice restaurant. I'm sure you think you deserved it.
Charles, you weren't at hotel California there, you were in jail.
You were told to move and you didn't obey orders. That's why you ended up in jail.

There are People Employed by the City of Saint John New Brunswick and probably the Crown were caught committing crime(s) against a Canadian ! Serious Crimes on top of that! I think some People that read this blog are obviously STUPID,if they can do it to Charles they can do it to you too! This alone should concern everyone as these people are criminals and belong behind bars and given the maximum sentences as they know full well and better than most anyone what they have done and what they were trying to acomplish,but the criminals are Public Employees who answer only to the Mayor of Saint John and to the Justice Minister of New Brunswick! I wonder how far down the hole this conspiracy goes?

You claim you don't want this to end up as yet another "anti-Charles LeBlanc blog", well if thats the case try blogging this poor girls story not yours. Your problems don't even come close to what happened this this girl. When you say your stating facts lets have the facts of this case not your own petty problems.

Charles says that he has more blogs on this in the future, and he has blogged on this in the past. In this particular instance its perfectly reasonable to show what 'could' have happened in this case (which we don't know) by explaining what happened in his.

I'd agree that there aren't enough stories of late on the residential tenants act (still not proclaimed) and there hasn't been that much on poverty, but it is a blog. People don't go to other people's blogs and say 'why do you keep talking about your opinion?'

It doesn't need to be restated that this is Charles blog, and at some point a warning label should be attached "If you don't want to hear about Charles Leblanc then don't come to his blog".

Charles doesn't get paid, and certainly isn't living the high life. Setting up blogs is free so if people want to hear more stories about the poor then simply get more involved, even sending them to Charles will get a mention.

The blog was an excellent illustration of the viewpoint of those who are in jail and what could have happened to them, his example simply makes that even clearer-and since we don't know the specifics of this case obviously he can't talk about that.

If people aren't just being belligerent then they should take more part in sending Charles stories because if you know anything about Charles, he thrives off the complaints of the 'nameless cowards' as he calls us.

This is a serious issue and all we get are stupid remarks about copyrights and talking about yourself and about the anti blog comments.

Mistakes were made in this case and they did lead to her death.

No matter what; we have to stop making excuses and the justice system needs to step it up and do a better job.

Putting her in jail for throwing apples; this needs to be corrected.

Not everyone is aware of people who need help and that to me is the number one problem. Also the people who run the system don't care what you did or who you are and what problems you have. You are treated the same or they lead you to think that. Different illnesses should be dealt with specialists not just the guards on duty.

This beautiful girl who happen to be 19, needed help but no one was there in our system to protect her.

She was not a real threat to anyone; she could have been helped with out prison.

Someone needs to say they made a mistake and try to make things right.

Her family deserves that at least.

Do you have to wealthy or famous to get justice?

What happened to charles has nothing to do whith this girls story. To not be able to see that shows your as blind as he is and cares just as little about her cause. As to the suggestion that charles will continues to blog about this is irrelavant there isn't a blog he posts that he doesn't claim that we all should "stay tuned". The proof will be if he can manage to actaully make it through the first paragraph without it becoming another "charles life" yet again.

It's obvious that no matter what charles posts there will be people who complain. As for 'caring', where is your blog post about it? I always thought Charles was just paranoid, but this proves there are a few Irving and government people here just belittling the guy no matter what he does.

I'm sure Charles gives those types of posts the attention they deserve. Good work on this Charles, it was a good way to help explain the problems in the judicial system-by your example.

It's clear many don't want you to talk about yourself since you're a good example of what goes wrong with the legal system, and its clear that lots of them don't want it discussed. Good blog.

No wonder people feel that there is something wrong with our society today.

The facts are injustice happens to many people and it is wrong.

To turn our heads because she is not important enough or you feel another issue deserves to be discussed; sure explains alot of why we have big problems with our system.

I am sicken to think a troubled 19 year old is put in jail for throwing apples; then not given the help she needed. Praying for her family and honestly for the justice system who screwed up.

Accountability in the courts to change things should happen right away.

I think he has been more patient with these "Charles Haters" then anyone would ever allow on other Blogs.

Charles Blog doesnot have to post what we want; but he does.

Just wish people would comment on helping or suggesting what could be done. Oh no we have to read comments that just give such a waste of time.

Charles how many years have you been on this Blog. I first found this Blog when the Mayor and Councillors of Saint John made a deal with the Irvings behind closed doors about the LNG.

CFBC off air and no where to voice and read other peoples thoughts. Average people have rights too. Can't get some of these issues in the local newspaper.

As for anonymous 8:15 I doubt name calling has much to do with the topic either but just for the record maybe you should actually read what has been posted here. There is at best one comment that has anything to do with the topic and Its safe to say it wasn't from you.

Ashley was not left to die. People worked hard with her every day in prison but Ashley didn't want the help. The guards are trained and do a great job. The criminal charges that were laid on them should be on the top mangement and not the guards. They do their job following the laws they are governed by and their hands are tied. You don't have the facts and never will understand. Those guards are wonderful people and the only people who should have to worry about this is the head people in CSC.
