JAMIE IRVING AND LAWYERS TO SHUT DOWN THIS BLOG???

This is very serious stuff!!!! The Irvings are always printing lying stuff about me in their papers and now this???

I hope that Jamie Irving knows that I can continue a battle without a blog???

The Irvings use my ordeal in their paper and I can't blog it???

Old Germany again???

Here's the email-

Charles, I'm afraid you have been warned. We have repetitively asked you NOT to violate copyright laws by republishing articles from CanadEast without permission. At each warning you have thumbed your nose at our request and flagrantly continued to violate the law. At each instance we have kept detailed records and screen shots of your violations and your comments about them. There are no more chances.

We are now in contact with Goggle, who take copyright violation very seriously, and I'm afraid you can probably expect them to revoke your Blogger access. Please DO NOT even try to rant that its the Irvings out to bring you down again because you have nobody to blame but yourself. You have violated our copyrights over ten times in the past year and we simply cannot tolerate this unlawful behaviour anymore. You were politely warned and chose not to rectify the situation. Now you will have to suffer the consequences just like everybody else.

Don't worry Charles, if google decided to revoke a person's blogger account on the basis of cutting and pasting news article or for the omission of a quotation/hat tip/source, then they basically would have to revoke at least half the google accounts of North American bloggers as well as globally.

Let me tell you, if you've surfed blogs as long as I have, you realize that most bloggers don't even come close to understanding the intricacies of copyright rules or journalistic standards.

Keep blogging away buddy as the statement by Scott Agnew sounds like a very languorous threat to me.

For the record, taking Mr Leblanc "off the internet" is not my concern. What is my concern as Web Services Manager for the online division of Brunswick News Inc. is the protection of our copyrights. We have politely asked Mr. Leblanc to cease and desist from violating these copyright son a number of occasions. He has refused to remove offending articles and continues to violate our copyrights time and time again. Copyright laws exist for a reason and it is my obligation to enforce our rights under the law. As i said in my previous email, Mr. Leblanc has nobody to blame but himself. He was given ample opportunity to correct the problem. He chose to do nothing. And also, for the regard, Jamie Irving has nothing to do with this situation Mr. Leblanc. As publisher of the Telegraph Journal, Mr. Irving has little to do with the day to day operations at CanadaEast Interactive. I'm sure Mr. Irving has many more important issues to deal with on a daily basis.

This issue cannot be debated with the Irvings because they have blocked my email.

So therefore I can.t send them an email but it would be interesting to see if the Irvings who have bloggers on their payroll?

To see the Irvings go against Bloggers would be a great story for the CBC?

I wish the Irvings would do like they did during my trial in Saint John.

They ignore the story but picked it up once the story hit the New York Times-

It may sound like a "languorous threat" to you but I assure you, we are serious about protecting our copyrights. I would direct you and Mr. Leblanc to Google's own copyright policies as they relate to the Blogger service: http://www.google.com/blogger_dmca.html
We have followed those policies to the letter. I would have preferred it if Mr. Leblanc had done the same.

Yeah, the Irvings are out to get all the bloggers! Try again Charles. The email is very clear to any semi-intelligent reader. They are not out to stifle free speech, they simply want you to stop stealing their articles. You copy and paste articles from their sites which is a clear violation of their terms of use and intellectual property laws. The Irvings are not out to shut down all bloggers. They have asked you to stop stealing and you told them to go %$#@& themselves. I hope Google does follow their own rules and shuts you down.

Charles, Charles, Charles. Do yourself a favor and read up on copyright and intellectual property law. It makes no difference if you are the subject of a coyprighted story, you still have no right to steal it. Do you think Mohammed Ali has any rights to the movie based on his life? What about Queen Elizabeth? Do you think she should be able to screen the movie The Queen and charge admission to it because she's the subject of the movie. You have very clearly broken the law and Scott Agnew, along with many of your own commenter's, have told you so. You ignored them every time. Now you get what you deserve.

This is very unfortunate, since although its all about 'you', the world doesn't revolve that way.

It is too bad, but not unexpected. I and others told you on numerous cases to simply post the first paragraph or else write your own damn article using footnotes from their article. That's how everybody else does it.

The Irvings have money and clout, and why would google stand up for one blogger who constantly breaks copyright law? If I write a story about Irvings that doesn't mean they own it and can print it if they want to. And actually, the Irvings have been a model of restraint compared to many other corporations out there who will sue people at the drop of a hat. There are corporations that sue because some blogs just 'make them look bad and so are bad for their image'.

But Charles has been warned on numerous occasions. As the bible says, pride goes before destruction. Hopefully Charles will rethink this, what a stupid way to see the blog come to an end. Google takes this stuff very seriously-when they get complaints, which isn't that often.

Hopefully Google will give Charles another opportunity before shutting off the account, I urge Charles to take it. The articles are not even that interesting or integral, what a dumb way to lose an account.

I advise Charles to make a backup of all the articles just in case.

Its a shame your adviser left the city, he might have told you to let this go, apologize and remove the article as posted. Mind you if I recall correctly he was around for all those other articles so either you never listened or he never was much of an adviser in the first place. All you have managed to show with your rants as posted here is to show Google you not only repeatedly refuse to followed the rules you actually don't even care. It really is a shame to find out you are willing to throw away any good you might have done all because of your own inflated ego. They don't own the Miramichi paper the Woodstock paper, the Campbellton paper the French paper and all the other little ones. They only own the biggest ones which are the Moncton paper the Fredericton paper and the Saint John paper.

More lies. It's about time someone did something about this blog. You had the perfect tool to talk and discuss important issues and you turned it into your personal attack tools on New Brunswick citizens, New Brunswick industries, New Brunswick Corporations and the New Brunswick Government.

Then why do you always call yourself a journalist? If writing in a diary makes someone a journalist, a lot of teenaged girls are journalists. Of course they would probably write better than you.

This isn't about freedom of speech. This is about theft. You stole their intellectual property, which is ILLEGAL, so no matter how you spin it, you're wrong, Charles. If the Irvings did this to you, you wouldn't be half as polite as they have been.

Hmmm, the Irvings giving out free lessons on freedom of speech. Almost as bad as that veil law being pushed by the clueless Marc Mayrand. Laughable.

Instead of picking on those who copy and paste from newspaper articles (90 per cent of the blogosphere), maybe you should spend more time helping out the poor editors at your three daily english rags who continually f%&# up the titles and push through articles with numerous spelling errors.

At this point in the game, I'm starting to truly believe that if the Irving's took their newspapers out of circulation, literacy rates in New Brunswick would increase tenfold.

Oh yeah, while you're at it, instead of demonizing him, maybe you should ask Charles to hold a seminar for your 'popular blogs section'. I mean, let's be honest, even Charles realizes that popular equates people actually reading the stuff. :)

Warren Kinsella, Paul Wells and Small Dead Animals all have posted full articles written by people other than themselves. Two of those three bloggers actually work as journalists for the national post and Macleans.

Yes, they are not using google tools to blog, but regardless, if you go by the copyright laws you cited, it means they are in violation and should be shut down. Very curious behaviour for two individuals who graduated from Carleton with journo degrees and generate more traffic in a day than the Irving online newspapers do in a month.

Let's face it, this is a personal vendetta to shut down someone who exposes you guys for what you are. Let me tell you, if you go through with it, your organization will never recover from the online backlash created by...

Its different if you HAVE PERMISSION, which two of those three bloggers/writers no doubt have.

Copyright infringement is rampant on the net, we know that. The difference is whether the media or person who owns it will take it to court. Its sadly ironic that if Irving printed a Charles article verbatim, there is almost literally nothing Charles can do about it.

So there COULD be a backlash against Irving, but probably not from New Brunswickers, but from the blogging community.

It's clear that Irving is in the right here, no question about it. It's also clear they can't let this continue. This isn't a case of once or twice or just posting a quarter or half an article. If it continued long term, then it sets a precedent. If somebody else set up a blog and simply cut and posted the most interesting articles, then why would anybody buy the papers?

So Irving HAS to do something here. Hopefully Google will give Charles a first warning, then his complaint will not be with Irving but with Google 'shutting down free speech'.

PS, that was the funniest damn thing I've read in awhile- "wiping my ass with the TJ and reading Majesta" I'm going to copyright infringe that one!

If you did you would not have bothered him.
He might be too old for a fist fight but he has the biggest mouth in the world and he will go to the extreme to fight for what he bereaves in whether its right or wrong.

He never forgot about the anything the that happened with golf, the shipyard or anything the Irving’s did to him.
Same as the leg, Dan Bustier etc.
When the cops arrested him did he back down? No he did not and its not over yet.

For someone who does not allow profanity on their blog, I would politely request that you post the entirely of your email to me on your blog VERBATIM. If you don't, please cease and desist from sending me childish, profane and threatening emails (you did warn me to watch my back which could easily be taken as a threat to my personal safety).

Now, as I've said before, I have no wish to have your blog removed. All I've asked is that you obey the law as it relates to copyright and more specifically to our copyright. If you obeyed the law, there would be no problem here. The ball has been in your court since I sent the first request to remove our copyrighted material from your site.

Am I the only one who wonders if "Scott Agnew" is legit? First, I can't see one of the Irving flacks coming on here to debate Charles and contribute to the comments section. Second, in some places, this guy's spelling and word use leaves something to be desired. I wonder if this is a set-up by someone having some fun at Charles' expense? It doesn't fit the Irving approach to this sort of stuff. Does "Scott Agnew" really work for the Irvings?

The rhetoric and threats coming from Canada East and Scott Agnew are very concerning. Yes, Charles may have overstepped a few copyright laws, but who's to say that most bloggers can even identify with the word copyright, better yet, understand it.

And to be so self-righteous in thinking that most of us haven't tripped up on this rule a few times as bloggers before. Furthermore, coming out and attacking Charles like a pitbull off his leash is irresponsible to say the least. For your sake, i hope it is someone posing as you Agnew.

Let be honest, this whole ordeal speaks more to the lack of humility demonstrated by Mr. Agnew than it does Charles' inability to follow guidelines.

So you are successful in getting Charles banned from google. So what? All this does is reinforce the dictatorial nature of Canada east and those associated with it (the Irvings). Not to mention, it sets a very bad precedent, in that, if you disagree with the newspaper owner, you will be banned. The Irving organization already has a bad enough name amongst the NDP, post-secondary insitutions and conservatives, now you want to taint your brand amongst bloggers. Wow, I say go for it, but be warned, you probably will add another 500 years of disdain amongst NBers by going through with it.

I have to admit, the latest threats and tirades by Agnew make me wonder if the newspaper industry, both online and print, are starting to feel the financial pinch due to people changing the channel on them, in that, they are going elsewhere for their news and the truth. And let's be honest, if you're looking for the latter, you sure as hell aren't going to find it in the liberally dominated Irving press.

Not sure how Agnew thinks his tirade will help this matter? Carry on as you were.

Just look at the evidence...the spelling as fred says is...lets say vaguely similar to a certain blogger here....and look at the comments! For an attention starved blogger this is heaven. What a quaint idea, people going elsewhere and using the internet for the truth. As long is its the truth they happen to want to hear that is. The vast majority of users don't go in search of the truth, they go in search of places that agree with what they already want to believe. There is every bit as good an argument for blogs and other on line self interest sites being less about spreading truth than the main stream media ever was.

I don't think this will add to irving animosity much. The only place to hear about it will be CBC and they will have to at least report the truth-that the blog was shut down by Google after numerous requests by Irving to Charles to stop infringing on their copyright.

And actually, if you do some research even bloggers take this very seriously and have no love for people who simply swipe other people's work. Google says that they usually contact people first before shutting down their account, but they also have the right to simply go in and remove the offending articles. However, they have also been known in a few cases to simply close the account without even mentioning it to the author. Which means any day we could log on to the site and it won't be there.

This isn't anything remotely like 'old germany'. This isn't charles not being allowed to speak his mind, this is charles being told not to steal from other people. If he walked into a Big Stop and stole from there and said "its my right to feed myself" nobody would give him much credence. This is exactly the same. It's very very easy to simply write an article about the Irving article and even put in some quotes. But to do this ten times in a year is something that can't be ignored. I don't agree with having an Irving monopoly, but those are two separate issues. To be too lazy not to do that won't get much sympathy from the public.

Charles, do yourself a favour and bring someone with you to this "meeting" with this Agnew guy. You should have a witness just in case he later decides to say that you assaulted him or something. I'm really surprised that the Irvings would allow this guy to blow on as much as he has. Wonder if "greasy, gasy & oily" know what he's up to in terms of the messages he has been sending to Charles? Maybe this is what the "new" Irving empire will look like once the brothers are gone and the Jamie Irvings take over. Scary thought. Fred.

On the other hand if I were to take your advice and "just pass by and keep going until you get lost and cant find your way back"...wouldn't that just make me homeless like you? I am so sick of the Irving paper, ragg paper lying to us and putting their spin on the facts they want us to know. The TV news and radio is also contolled. Leave the Blogg alone. We need a voice and our opinions matter too.

People are so gullible and believe the crapp written in TJ so why not let us have a say.

Charles, CanadaEast by taking you this seriously gives you credibility. They should just ignore you. By harping on this and warning you over and over they only make you fight harder. One could argue that if you take the whole paper as a work your use of one whole article per issue is only a portion and fair use but if we were to advise you we would suggest that you should be a little less lazy and only cut and paste portions of any one article and paraphrase the rest. However since your identity is tied up in being a fighter you are not likely to do this. It's a shame all round. To the commenters- Charles is Charles -yes, sometimes rude, sometimes uninformed, sometimes off the wall. But if he is taken down in our view it will be still be a shame.
