LEGAL AID IN NEW BRUNSWICK - WILL T.J. BURKE TALK TO THE JUDGES BE ONLY LIP SERVICE????

I was told this little story a few days ago.

Judges and lawyers met with T.J. Burke to discuss some issues in the Justice system in Moncton.

One issue on the table was the Legal Aid System in New Brunswick.

Now? I didn’t know anything about our Legal System until my arrest in Saint John for taking pictures.

After my arrest, I was told that I had no right to a lawyer.

I was on social assistant and charged by the Police for Obstruction!!!

I was also told that I will have to represent myself in court.

I couldn’t believe what I was hearing???

The Saint John Police Force singled me out and now I have no right to a lawyer???

Their point is this – Chances are that you will be found guilty because we know only a fool represents themselves as a client.

But you will not be jailed because it’s a misdemeanour.

But there’s a catch????

If you break your probation?

YOU WILL LAND IN JAIL!!!!

Is this a way to jail the poor people in New Brunswick?

Now? On the first evening T.J. Burke was appointed Justice Minister, he told me that he’ll look into the Legal Aid system in New Brunswick.

The Judges told T.J. a few weeks ago they have been hearing this kind of talk for the last 20 years and they’re sick and tired of lip service.

Will T.J. Burke come forward to help the poor citizens who are singled out by the Saint John Police Force?

I have been told that our Legal System is the worse in Canada!!!!!

Is this true????

Charles, if you want to be considered a journalist, could not, at least, try researching a topic you are reporting on. For starters, there is no such thing as a misdemeanor in Canada. Secondly, you ARE entitled to speak to a lawyer after you are arrested (not before). Thirdly, no you are not automatically entitled to have a lawyer represent you if you are charged criminally. There IS however, always access to duty council while in court to help you "represent yourself". Why should I, as a taxpayer have to cover your legal bills. You got yourself in trouble, you should have to get yourself out. Legal Aid in NB has rules on who it will supply lawyers to and who it won't. Obviously, your case does not fit into those rules and you aren't covered.

We should be taught law in school just like math or science ? They say ignorance of the law is no excuse but we are purposley kept ignorant so they can run all over the poor! But NO NO we couldnt have that as people would be wise to the corruption and underhanded dealings that go on within the government and in the courts! Just look at what they did to Vaughn Barnette,shut him up for helping and educating the poor! check out Google Video video for (Bursting The Bubbles of Government Deception) or anything else by Rob Menard! Too many are starting to catch on to thier lies and deceptions!!!

Anony 10:27 Charles didnt get himself into trouble! The SJ Police Conspired to Criminally Charge an innocent Man? Yes you are entitled to a lawyer if it involves jail time and if you are questioned you are allowed council which the system is set up to withhold the lawyer from you as a person is poor or does not understand the situation they could be placed in they usually waive thier rights not understanding they are usually under duress! Basically dont talk to cops! cop tells you you have the right to remain silent do just that!!! Duty council is good for S##t! Why should your Tax dollars go to pay for Criminals with Badges and Guns? So if charles chooses a person like say(vaughn B) Hes not allowed because they will charge him for practicing law without a licence how about practicing justice and truth? Rules! Ha the courts dont follow them thats why their called ACTS because they are a bunch of actors putting on a show in the theater some call a court room! www.injusticebusters.com and look at your waste of tax dollars in our ever increasing Facist Corperate Police State!

Surprised it took so long to start the police state rant. Even managed to get fascist in there...why you would almost think anonymous 5:15 new what he was talking about.(just kidding, I know it isn't even close to almost) As for Mr Barnette, he can barely help himself thats why he never managed to become a lawyer in the first place, why would he be any better than duty council?

At least Vaghn would look at the facts where duty council will usually flip open your file for a minute close it and tell ya to just plead guilty, man that is some council ?!

Ya Must be a Dumb one if you dont notice whats going on around you and the world ? Yes we are in a police state if you havent noticed or are you part of the state thats why everything looks so rosey to you?

Well anonymous 11:27 if what you think you know about me is any indication then it is painfully obvious you know very little about anything. Thats not surprising though. Misguided little people like yourself have to direct that anger somewhere and others are by far the easiest target. I understand, you can't help it, its just a way to make up for your own inadequacies. Probably something to do with your lack of personal self esteem or maybe its just a vitamin deficiency. Frankly your not in a police state nearly as much as your in an altered state. You should consider seeking help. There is a lot of free help out there you know and I suspect living off of others is something you do well anyway.

"Wrong place, wrong time" isn't just an expression. It could land you in jail.

"Dean" was a Nova Scotia university student out with some friends one weekend night. The evening's festivities eventually brought him to another person's house, where Dean settled in for a while.

But the party ended in a hurry when police raided the home, acting on information that marijuana was being grown in the basement. It was, and the police arrested and charged everyone on the premises - including Dean, who knew nothing about the marijuana until the police busted in.

Dean suddenly found himself charged with cultivation of marijuana, along with everyone else in the house. But there was no evidence connecting him to the crime other than the fact that he was found on the site. Not only that, he had a very reasonable explanation as to why he was there. Anxious to prove his innocence, he refused to plead guilty, intending to fight the charges in court. But that was going to prove an even greater problem.

As soon as he was charged, Dean was fired from his job. Without any source of income, he applied to Legal Aid to help hire a lawyer. But because Nova Scotia Legal Aid won't fund anyone charged with what they call an "enterprise crime," they turned him down. Dean appealed that decision to the review panel, but was again refused legal aid.

As a result, Dean had to face the legal system alone, a process he found overwhelming. At one point, trying to select jury members, he was being threatened with contempt of court because he continued to maintain that he couldn't represent himself and needed a lawyer. Finally, a lawyer agreed to help him as a favour - as lawyers in these situations so often do - but he has no idea if he'll ever be paid for his work.

This true story is the latest installment in the Canadian Bar Association's continuing "Legal Aid Watch," tracking the instances in which our underfunded legal aid system fails ordinary Canadians. People who just want to prove their innocence are denied the basic ability to seek legal assistance. Lawyers, who see first-hand how the underfunding and neglect of our legal aid system hurts Canadians, won't stop reporting these stories until governments accept their responsibility and fix legal aid once and for all.

Yep! There are some honest lawyers out there who really want a change but sadley are far and few between! Some people have a conscience even lawyers!

Goverments will never accept responsibility! unless people get off thier duffs and hold them to thier words?? Canadians are apathetic and expect care and proper treatment from cradle to grave but thats a dream !
