SCOC dismisses Irving tax case

Irving Oil has lost its bid to have its property taxes reduced at its Saint John oil refinery.


Irving Oil has been fighting to have $20 million worth of oil tanks at the refinery classified as manufacturing equipment and declared tax free, but the Supreme Court of Canada has dismissed Irving's request for a hearing on the matter.

Irving originally won the tax case at trial, but that decision was overturned by the New Brunswick Court of Appeal last March. The Supreme Court has now ruled the Appeal Court decision should stand, meaning Irving is not entitled to a tax reduction.

Irving Oil had been fighting for years to have taxes on its oil refinery cut by about 25 per cent. At issue is a section of the property that holds dozens of huge oil tanks. The company pays about $4 million a year in property taxes, with about a million in taxes coming from the oil tanks.

The taxes are split between the province and City of Saint John.

Irving Oil claims the tanks shouldn't be taxed at all. It wants a reduction and would like the provincial government to refund taxes paid between 2001 and 2004.

Saint John Lawyer John Barry says oil storage tanks are normally subject to property tax in New Brunswick but manufacturing equipment is not. "The issue of the tanks is whether they're part of the manufacturing process or whether they're used for storage."

In Irving's case, the company says although the oil tanks store finished petroleum products, those products have to be constantly stirred, which makes the tanks part of the manufacturing process and should be tax free.

Barry does not represent either party in the dispute, but says the case is simple. "If they're part of the manufacturing process, they fall under machinery and they're exempt and not subject to property tax assesment. If they're storage tanks, they do fall under property tax assesment."

Irving Oil's property taxes are a sensitive issue in Saint John. Protests broke out on the streets and inside Saint John council chambers earlier this year after Irving Oil received a $100 million property tax cut, spread over 25 years, on a planned Liquified Natural Gas terminal in the city.

Saint John City Councillor Glen Tait says Irving Oil is well within its rights to fight property taxes at the refinery too but is afraid the public isn't in the mood to hear about it. "This certainly will revitalize the whole issue and bring it to the surface again, and there will be discussion on that whole issue again...here we are –another tax break for the Irvings."

If Irvings' candidate Michelle Hooton wins the election may be she can help. Bernie Lord and Michelle Hooton will work diligently on the case to give Irvings the tax break they need. Lord already rushed a legislation through the House to give Irvinng over $100 million in property tax break for its LNG terminal. May be Michelle and Lord can work together on this new project, enact a new legislation and put through the House. If Saint John Harbour elect Hooton that is what they might get.

ALRIGHT!!!!! Could this be a start to a new trend?? The people really do have the power and it's about time it's being exercised?!!

This is GREAT NEWS for the City of Saint John and I don't think it will break the Irvings in the same way they're trying to break the city and it's people.

Charlie this is a good thing that has happened for the people of Saint John and I think you should keep it within the boundries of decency by just showing the pic of Irving but hey it's just a suggestion of proper print I could be wrong but if your looking for good following you have to have respectful taste on your views.

This hitler bit is just too much as a large percentage of your readers have given you grief on this issue in the past and will in the future.

Good! Business should pay it's fair share of taxes, no more, no less. That rate though must always be competitive with our neighbours to keep jobs though.

Spinks, Being a resident of Saint john I can tell you,Our Highest price to the Irvings on anything probably doesn't even compare to the Lowest bid of any other Province as they tend to have such a strangle hold on our city.

Have no fears the Irvings know a good thing and they have absolutely no plans on going anywhere else but right here.

Lowest prices,Taxes,least amount of resistance and envoirnmental laws, why would they ever want to shop any other place then right here in good ole Saint John N.B.

Or as they would say Sap City.

6:47pm - I understand where you're coming from. I don't have any great love for how the Irvings do business and I avoid doing business with them, although I buy one of their papers because there's little choice. However, I wouldn't wish for them to leave the province (not that they would, but I still don't wish it). They do provide a pile of jobs which may or may not be picked up in their absence. I wouldn't want to test it.

That's really not true. Pretty much any province or state would take them and their 5 billion annual revenue. Anyway, you are right they're not going anywhere.

Irvings will have hell of a time in another province or jurisdiction. No one will give in the way our provincial government does. They have many names for Saint John because of the pollution. No other city will allow that.

REST ASSURED THE IRVINGS WILL DEFINITELY HANG AROUND FOR AT LEAST ANOTHER TWO YEARS!!! AS LONG AS YOU HAVE THAT "MICKEY MOUSE MAYOR" WEARING HIS "ROSE COLOURED GLASSES".... THE CITIZENS WHO WANT CHANGE BETTER MAKE IT TO THE BALLOT BOX ON NOVEMEBR 14TH, OR IF NOT, THEY DESERVE WHAT THEY GET...IF THEY WANT CHANGE THEY CAN MAKE THE CHANGE WITH THE PROPER "X"....!!!!

8:12 I totally agree with you enough overkill.
I come to this site a couple of times a week, for a few days it seems charlie has cleaned up a bit and seems to have a bit of focus going on and all of a sudden you pop in and it's all out of control again?
Charlie if you can get all of your personalities to get together and under control you will earn a proper following because when your calm and collective you are able to produce a good story at times.
speaking of that how come you haven't done one in a while seems wcie artist pics are becoming the norm here.
Whatever happen to your long variety write ups??
