Bill would enable police to get personal phone, Internet information Authorities should require warrant, says critic

OTTAWA - Security officials could demand personal information about phone and Internet subscribers under proposed legislation that quickly sparked privacy concerns Tuesday.
The bill introduced by the Liberals would ensure police and CSIS officials could obtain a person's name, address, telephone or cellphone number, or the technical data that identifies a computer's co-ordinates on the Internet.
The proposed law would also force phone companies and Internet providers to phase out technical barriers to police and security agencies seeking access to messages or conversations.
The measures represent the latest federal effort to ensure terrorists and other criminals cannot use advanced digital technologies to shield their communications from authorities.
Public Safety Minister Anne McLellan said Canada is "well behind other nations" when it comes to giving law-enforcement agencies such tools.
She said police must be able to "stop the child pornographer sending his disgusting images around this country and around the world."
Currently, before handing over customer data, communication companies have discretion as to whether to require a court-approved warrant from police or security officials.
Micheal Vonn, policy director of the British Columbia Civil Liberties Association, said police should have a warrant in order to obtain information about a subscriber.
"The point here is, if the police can't be troubled with getting a warrant, it's because they haven't met the standard of reasonable and probable grounds to access the warrant," she said. "On some level, it is what we would call a fishing expedition."
The government says release of subscriber information to authorities would be subject to stringent privacy safeguards.
Under the Modernization of Investigative Techniques Act, as the bill is called, telephone and Internet service providers will be required to include the capability to intercept messages in new technology they install.
Government, industry representatives and police are working out who would pick up the day-to-day costs of the plan, such as the fees incurred in hooking up security agencies to the communication networks.
Parke Davis, a senior regulatory officer with Telus, said he was worried about the potential costs to his company of both new equipment and ongoing assistance to police.
The government began consultations on the interception initiative more than three years ago.
However, the legislation introduced Tuesday will probably die on the Commons order paper, since an election call is expected in coming weeks.

First off, I am not an "Irving hater" by any stretch of the imagination. I respect what the Irving family has done in this province, building an vast empire, and employing New Brunswickers. However, I have a very serious problem with concentration of ownership of the New Brunswick media. Newspapers is what i'm refering to obviously. If Bell Canada or Canwest owned every newspaper in Canada with no competition, they would be in front of a commons committee in no time. They would be forced to divest themselves of some assets immediatly, as the Irvings were when the were called on the carpet for owning one radio station and one newspaper in Saint John. They did that. Since then, they have purchased not one, but two radio stations in the City of Saint John, and still own the paper. Plus every other paper in New Brunswick, except for the papers owned by Ossekeag Publishing Co. Ltd .Our federal and provincial governments seem to ignore the fact, that in New Brunswick, if you buy a paper you are buying the opinion of the provinces wealthiest family. As we've seen recently in Here Magazine, and in the Miramichi, the Irvings hold a tight grip on what they deem as acceptable for people to read. This is unacceptable, and needs to be changed immediatly. Bernard Lord and his government, have looked the other way while this situation developed, and need to take action. In any other province in Canada, this situation would never be allowed to take place. Why in New Brunswick? Is the old adage about Irving owning this Province really true? No wonder nobody wants to come here to live and work if this is the case.

I totally agree with Charlie on this one. We are talking about one nasty by-election that took place here in Saint John Harbour of which both sides had a lot to lose. Although realistically the Conservative Government had the most to lose.
This by-election has yet to be analyzed and explored by the people of New Brunswick as a whole from all angles. As is evident by their decision on the choice of a Liberal.
We all know that this is a much larger message to the Lord government than just the by-election and don't let the Lord Government fool you into believing anything less than that. This was indeed a ground shaker for lord and he is well aware of that fact.
I am one who is very suspect of his actions to keep a seat at the helm. I do not believe he stayed within the guidelines for spending as well as reserving my feelings on whether or not his team made a bad judgment call and willingly exploited Mr. Russell Perkins as a last minute voting blitz.
I am very serious when I say I think that issue should be looked at very closely to see if anyone crossed the line on dignity and respect for all life as a governmental representative of the public be it rich or poor handicapped or no.
To put on a performance such as that one was in my opinion, Nothing short of taking advantage of Mr. Perkins situation.
There are a considerable amount of irregularities that have yet to be questioned or answered for and as such this debate regardless of this blog cannot be seen as bias toward each individual's views I myself am suspect to a couple of decisions made by the Lord Government to try and hold a majority Government.
And Finally we all know the telegraph Journal will certainly not act on behalf of the people of Saint John when looking for answers.
So on that note I think blogs are a good source for exploring the answers to these questions as there is plenty of room for both sides to argue their points of view on this issue without worry of being cut short on their beliefs of the cercumstances.
We certainly hope Saint John stays focused and not let what happens in Ottawa effect what has been happening in Saint John and New Brunswick. Yes we are not happy with the sponsorship fiasco with Quebec; let the people there fix that. We in NB have our own Orimulsion Fiasco, high insurance rates, LNG tax deal with the Billionaires and many more issues. As we get closer to the Election, the people of Saint John and New Brunswick need to keep focused and get Premier a late Christmas present and vote him out. What he has done to NB and especially Saint John is unforgiveable and he needs to pay the price; after all Lord says the people can afford to pay more and believe me we will. Anyone who wants to start a list of what we Premier Lord has done or not done, please do. A notty list for Lord.
