CHARLES MAKES A COMPLAINT TO BERNARD RICHARD AGAINST NEW BRUNSWICK LEGAL AID!!!

A couple of days ago, I made a complaint to the Ombudsman Bernard Richard against New Brunswick Legal Aid.

My concern is the Saint John Police Force can single out any poor individual from the streets and haul them in court.

Once there, the bureaucrats will make a check on the individual and if he or she is known as a troublemaker?

They will face certain conviction by the courts because they will have to defend themselves.

Therefore they will be on probation and if they break their probation? They will end up in jail.

This is just a way to put the poor people in Prison.

If the Police decides the poor individual has broken the law?

They will be arrested and they know they won’t have the right to a lawyer.

If the Police goes on the witch-hunt < just like mine > proper duty counsel should be provided.

These bureaucrats decided that if a poor person commits murder? This is a reason for Legal Aid but any other case? The poor individual will have a record for the rest of their life.

This is pure discrimination against the poor citizens in New Brunswick.

I feel sorry for Mr. Richard because he has to put up with you, the wacko, so often.

Although police’s actions cannot be endorsed but if you were wearing a protest T-shirt then you are a protester. You were wearing protest but from your mouth you were saying "blogger". Make up your mind.

You are doing New Brunswick's poor a disservice by leading them to believe only those accused of murder can get representation through Legal Aid New Brunswick.

The rule of thumb for legal aid is you qualify if: (a) you are charged with an indictable offence, or (b) there is a possibility of a jail sentence being imposed if a finding of guilt is made.

There are exceptions, of course, but generally, that's how it works. Your obstruction charge certainly isn't likely to result in a jail sentence, and talk of the potential of a term incarcerated in a mental health facility is ludicrous.

Feel free to argue that legal aid is too limited, that anyone who qualifies under the financial criteria ought be assigned counsel no matter what criminal charge he or she faces. But don't act as though the establishment is out to get you based on your legal aid rejection. It was in keeping with Legal Aid New Brunswick's policies and has nothing to do with your politics or your conflicts with various politicians and government officials.

Thank for the comment but I must say that the max for my charge is 6 months in jail.

This has nothing to do with me. If a person is arrested like I was. < for taking pictures > and the poor is poor?

The odds are he or she will be on probation because it's their word against a cop.

At the end, Legal says - Well? This is not of any importance!!!

Excuse moi???

This is pure discrimination against the poor.

Especially if you have to deal with a corrupt Saint John Police Force who deleted all my pictures from my camera!!!!

The maximum jail sentence for most summary charges is six months. That doesn't mean you're facing a six-month jail sentence. Maximum penalties are reserved for the worst repeat offenders.

Realistically, if you don't have a history of obstruction charges on your record, you're looking at a fine or just probation.

As for your legal aid application being rejected, Legal Aid New Brunswick does not and cannot represent ALL defendants. It has to prioritize. You clearly don't have the facts as to how the organization operates.

You also seem to be confusing rejection of YOUR application alone as discrimination against the poor in general. That argument doesn't stand up. Legal Aid New Brunswick specifically exists to help the poor defend themselves against criminal charges and to handle family court cases. How can an organization that does nothing BUT help the poor be discriminating against them?

M. LeBlanc, if you want your comments and arguments to convince people, there has to be a certain degree of logic and fact to support them. Accusations alone serve no cause well.

I have said what I had to say and all I know is that if the cops haul you in court and charges you in a flase manner? < Like me > The individual could have a record for the rest of their life because they are not intilled to a lawyer. They will have to represent themself. Not right at all!!!!
