Bernard Richard - Further, blogging is a new phenomenon and......

I recommend that in your appeal application you raise the third
criteria, extraordinary circumstances and the best interests of justice, as the reason you should be eligible for a Legal Aid Certificate.

Given the unusual and extraordinary circumstances that led to charges being laid against you and the uniqueness of your case it could be argued that it would be in the best interests of justice that you are provided with legal representation.

The protest that led to your summary conviction involved extraordinary circumstances, meriting legal representation, as you claim that the police failed to understand that as a blogger you were not acting as a participant in the demonstration.

Further, blogging is a new phenomenon and the handling of your court case could become a significant part of a larger body of law binding on other citizens and bloggers.

Based on the implication the findings will have on others,
you could argue that it is in the public interest that you receive a
fair hearing, part of which mandates the provision of legal
representation.

I trust the above is satisfactory to aid with your appeal. However,
should you have any questions, please do not hesitate to contact me
personally at this office.

Drugs could push election hot button

Carl Davies
Telegraph-Journal

FREDERICTON - While addressing the problem of drug use in New Brunswick can't be found in the Liberal election platform, leader Shawn Graham says it could emerge as a "hot-button" issue during the campaign.

Graham was speaking Monday after notes for a speech he never delivered were accidentally released to the media Friday.

According to Graham, the speaking notes were written by Fundy Isles MLA Eric Allaby, who wants a public inquiry into recent riots on Grand Manan sparked by residents' anger over drug trade on the island.

Those notes called for a provincewide inquiry into illegal drugs.

Graham confirmed Monday that such an inquiry is not in the party's platform, but it's something he's keeping a close eye on after the issue was repeatedly raised during his visit to Charlotte County this past weekend.

"We recognize that this is a serious issue," Graham said.

"This could be one of those hot-button issues that pop up on the campaign."

For now, Graham says he wants to keep the campaign platform focused on three main themes, energy, education, and the economy.

A public inquiry is not the only way to address the drug problem, Graham said.

"There are other options as well," he said. "It doesn't have to be as formal as a public inquiry."

Graham said one option could be a panel that travels the province for roundtable discussions on how best to address what can be a complex problem.

The Liberals will be promising a prescription drug monitoring program, more money for methadone clinics, and more money for at-risk youth.

The Liberal leader also noted that the drug problem "does play into education and the economy," two of the three main Liberal campaign planks.

Graham said he would prefer a serious issue such as this one not become a political football during the campaign.

But the issue has been earmarked as something that might have to be addressed in more depth as the campaign unfolds.

"It's something we're keeping an eye on," Graham said.

SAINT JOHN POLICE FORCE KNOWS HOW TO HANDLE A BLOGGER!!!! IF I WOULD HAVE BEEN AN IRVING EMPLOYEE MAYBE IT WOULD HAVE MADE A DIFFERENCE???

ARREST, originally uploaded by Oldmaison.

First they put the blogger against the wal telling him he's under arrest.

Second, they parade the blogger 15 feet in front of all the media.

ChalieLeBlancArrest

At the end, they force the blogger on the ground. I had two lumps on my head and they deleted around 100 pictures from my camera.

police

Going back to the first picture for a minute. Why didn't they just put the handcuff on while I was standing up? Why did three police officers jump on my back?

There must be a public inquiry on this issue.

WILL BIGOT MATTHEW GLENN BE AT CITY HALL ON ACADIAN DAY???

I doubt it because we’re dealing with high powerful people here.

I also wonder if the Irvings will once again call me a protester or even cover this sad story?

You would have believe they would have covered the part where the Saint John Police Force deleted all my pictures? Something is very strange here. Not a news maker I guess? Which me luck!!!

A few days ago someone bought this interesting site to my attention.

This truck is park in the middle of the City.

IMG_7294

In its place used to be a dumpster.

I guess the bureaucrats made a complaint about the smell so they got rid of the dumpster and in its place they station a truck.

From what I’m told? They put the garbage in the truck and haul it to the landfill.

IMG_7295

There’s only one itty bitty problem with this picture?

It carries the garbage of the employees from New Brunswick Family Services.

IMG_7297

So they cannot afford a raise of the welfare rate but they can afford to rent a Truck?

How much are the taxpayers dishing out for this one?

Please explain?

Hurry up!!!! I'm next!!!!

BERNARD RICHARD REPLIES TO CHARLES'S COMPLAINT AGAINST NEW BRUNSWICK LEGAL AID!!!

Charles 04_07_05 008
Originally uploaded by Oldmaison.
Mr. Charles LeBlanc

Dear Mr. LeBlanc:

This email is further to your complaint to the Office of the Ombudsman
with respect to the refusal of your application for a Legal Aid
Certificate. I wish to advise you that in accordance with the Legal Aid Act
and a relevant regulation under the Act, Regulation 84-112 - Legal Aid
Regulation, you may appeal the rejection of your application for Legal
Aid.

I recommend that you appeal the refusal of your application in
accordance with sections 41 and 42(1) of the Legal Aid Regulation by submitting
Form 7. The relevant provisions pertinent to your right to appeal
under the Legal Aid Regulation are provided below:

41 Where an area director refuses to issue or amend a legal aid
certificate or determines that he will issue a certificate on condition that
the applicant make a contribution to the cost of the legal aid applied
for, he shall notify the applicant in Form 6 and shall furnish the
applicant with Form 7 and, where appropriate, Form 4.

42(1) Where an applicant wishes to appeal a decision referred to in
section 41, he shall complete Form 7 and deliver it to the office of the
area director whose decision is being appealed.

Officials from the Legal Aid Services Commission informed us that they
mailed you a letter with Form 7 on August 2, 2006, but have not yet
received your appeal submission. If you have not yet received the letter
and/or have misplaced the form you can locate a copy of Form 7 online
at:
http://www.gnb.ca/0062/regs/pics/84-112.pdf (page 19 of 64) or by
opening the PDF file I have attached. Officials also advised this office
that it is not an available option for you to submit Form 7 by email;
the form must be hand delivered or mailed to the Saint John District
Office.

Based on the nature of the charge against you, which is a summary
conviction offence, the New Brunswick Legal Aid Services Commission is not
obliged to provide you with a Legal Aid Certificate. The Commission
will in some circumstances make an exception to their policy for persons
charged with summary conviction offences if one of the three following
circumstances exists:

- there is a likelihood of imprisonment or loss of means of
earning a livelihood upon conviction;

- there are circumstances that would serve to mitigate the
severity of the imposed penalty; or

- due to extraordinary circumstances, it is in the best
interests of justice that the applicant be given legal representation.

I recommend that in your appeal application you raise the third
criteria, extraordinary circumstances and the best interests of justice, as
the reason you should be eligible for a Legal Aid Certificate. Given the
unusual and extraordinary circumstances that led to charges being laid
against you and the uniqueness of your case it could be argued that it
would be in the best interests of justice that you are provided with
legal representation. The protest that led to your summary conviction
involved extraordinary circumstances, meriting legal representation, as
you claim that the police failed to understand that as a blogger you

significant part of a larger body of law binding on other citizens and
bloggers.

Yours truly,

BERNARD LORD SHOULD HAVE SHOWN TRUE LEADERSHIP!!!

IMG_7208
Originally uploaded by Oldmaison.
Leadership in New Brunswick is lacking big time!!!

There’s our Premier telling the media if Peter Mecheau leaves then he have no choice but to call an election.
IMG_7217

But if he stays? The next election will be in October 2007.

IMG_7225

To make matter worst? Bernard Lord said that he’ll visit the Lieutenant Governor on August 19 asking for a election.

This is getting more confusing that the Tanker issue!

STB_0768

He should have shown leadership and look directly at the camera and say- WE’RE GOING TO HAVE AN ELECTION!!!!

IMG_7215

Poor Bernard, he hasn’t been the same since the by-election in Saint John.

IMG_7208

Thank God that he lost that one!!!

Bernard looked very tired today and I believe that he knows that the end is near.

He did save face by going into a election before the pensions kicks in.

By following this action, he won’t have that dirt on the campaign trail. He did do something right.

Hey maybe like Tanker Malley??? He'll change his mind AGAIN????

I believe that he truly understand that the ned is near.

I heard around 4 weeks ago that he was going to do this but only blogged the story last week. You could say that I did beat the Irving paper to the punch....lol..

POOR PEOPLE FACE CERTAIN QUICK DEATH IN NEW BRUNSWICK!!!!

Why in hell should these people have to LITERALLY suffer?

I’m talking about the loved ones who go through the STRESSFULNESS of it all.

...... and have nowhere..... no one .....no organizations to turn to and seek help for their unfortunate predicament.

The working poor doesn’t have anywhere to turn to because the system don’t seem to care.

For example? If you’re on social assistant. A person has a health Care card but the working poor doesn’t.

Can you imagine making seven bucks an hour and trying to obtain the high cost of a prescription drugs to prolong your loved one life?

It’s virtually impossible.

Lets look at all the facts here!

Lets say I wish to travel to Saint John? How can “ US POOR ” individuals afford this high cost of travel?

It’s just plainly monotonous!

With the price of gas and insurance? Need I to say more?

Where does a person stay while he or she is in Saint John?

The Delta or the Holiday Inn????

The bottom line of my letter on this issue is if you’re the working poor and you live in New Brunswick?

You will definitely meet a certain and short death!!!!!

Hope we all meet in the BRIGHT SKIES!!!

Friday evening was crazy in the Capital....
