Arthur Irving sues man with ties to LNG protest for harassment
Feces, garbage dumped on property at industrialist's Mount Pleasant home

A man involved with the anti-LNG protest is being sued by Arthur Irving Sr. for harassing the industrialist at his Mount Pleasant home.

A statement of claim filed at the Court of Queen's Bench names Saint John's Stephen McGoldrick as the defendant in the case. Mr. Irving and Sandra Irving are the plaintiffs.

The claim says that Mr. McGoldrick dumped feces and garbage on the Irving's Mount Pleasant property over a period of several months. The trespassing incidents started last summer and continued until last month, according to a court document.

The document also says that Mr. McGoldrick has threatened to continue to dump the noxious substances on the Irvings' land.

None of these allegations have been proven in court and Mr. McGoldrick has yet to file a statement of defence.

The Irvings' lawyer, Rod Gillis, deferred to the statement of claim when contacted Friday.

"You can read that for yourself," Mr. Gillis said. "It's filed with the court. That's all I can say."

The statement of claim says that "as a result of the Defendant's actions, the Plaintiff's property has been defiled and rendered less fit for occupation or enjoyment." It also states that because of Mr. McGoldrick's actions, the Irvings "have been unable to enjoy peaceful possession of their property."

The lawsuit asks the court to stop Mr. McGoldrick's harassment, bar him from entering the properties, as well as to ban him from having any contact with Mr. and Mrs. Irving, "whether direct or indirect."

Mr. McGoldrick has been involved with the anti-LNG protests that pitted a group of citizens against common council, which approved the deal, Irving Oil and its partner, Repsol.

The Coalition of Concerned Citizens, Unions and Small Businesses was founded last year by Bruce Court, a retired local railway man. Mr. McGoldrick is part of the organization involved in noisy protests that packed council chambers and held demonstrations, enraged at a controversial tax deal arranged for Irving Oil. The deal was negotiated by Mayor Norm McFarlane and Irving Oil. It allows Canaport LNG to pay $500,000 in property taxes a year over 25 years. That's about 10 per cent of the estimated $5 million annual tax bill, enraging the citzen's group.

In an interview Friday, Mr. Court initially said he didn't know Mr. McGoldrick. He then suddenly remembered the man who sat next to him last June at a meeting at Harbour View High School. Although Mr. Court said he knows a lot of people and doesn't know Mr. McGoldrick well, he could name where Mr. McGoldrick lives and name his wife. He said the man is still a member of the protest group.

"Oh, yeah, I know Steve," Mr. Court said. "What's that got to do with?"

But Mr. Court said that he didn't know anything about the alleged incidents at the Irvings' house, let alone where Mr. Irving lives.

"I don't want anybody's property damaged. I don't agree with any of that stuff," Mr. Court said.

Mr. McGoldrick could not be reached for comment.

Yes, Mr. Court deserves it. He puts himself out front of a group whose members are comfortable with vandalism of homes and card, racism, and mob tactics. Notice I said, puts himself out front: it's not like the media are pushing him into the spotlight, he's jumping up and down looking to attract its attention.

This interview raises questions about Mr. Court's honesty, and well as his judgment in terms of the company he keeps.

I happen to agree with those who think the Irving LNG tax deal reeks, by the way. But I'm against mob tactics, too.

How is it 'mob tactics' when its the work of ONE guy? Perhaps people never made it through grade school but you need more than one to make a mob.

It's good though to see people on the same page, the above poster agrees that it would be great to see Irvings leave. Of course they already left, they live in Bermuda and have five or six homes around the world. Of course its too much to expect people to know how to read economics but there have been numerous studies done showing the presence of Irving AND McCains has been bad for the province. Don't think so, just look next door at Nova Scotia, just about every economic indicator is far higher than in NB.

If they were so great why exactly does the industry of one of the worlds' twenty richest families, exist in a province that's poorer than Alabama? And that in a province of less than a million people?

Irvings are the biggest subsidy pigs in Canada. THEY don't pay for all those services and jobs -YOU do. Where do you think this years quarter of a BILLION dollars is going? Who do you think pays their bills? By the way, it was the Premier that changed the legislation so that the LNG deal could go through, so its quite easy to blame BOTH Lord and the Mayor. Perhaps we should blame the deadbeats that made the demand in the first place.

I'm glad their getting garbage dumped all over their yard, and I"m glad their stay here is a little less comfortable. Now they have an inkling of what its like to be a New Brunswicker-I notice they are a long way from the gas line where they live. They can go back to Bermuda, or they can do what HONEST businesses do, which is pay their fair share of taxes. When you run the government and keep people in poverty, you have to expect a little garbage on your lawn. They should consider themselves lucky, look what happened to the Czar of Russia.

Bruce Court deserves how he was treated. Too bad they don't hold everyone to account like that though.

He needs media coaching. He should have said no comment or just the vandalism is wrong line.

I do agree that the Irvings are getting a sweet deal, but also agree the Courts are bad for Saint John.

Maybe Ivan's ticker will make him step down soon.

i certainly don't work for irving. and i trust bruce and ivan about as far as i can throw them. and since you have seen the size of them you know thats not far. just ask around the city to get the real info on these guys. i would be very careful about trusting either one of them. they are not what they try to pretend to be. fair warning.

Wait a minute some people can sure spin the bull and we can all do it!

I know the Mayor, I know the Councillors, I know the premier, I know the MLA's, I know Paul Zed, I know the Irving's, I know my boss, my Family and many more people but don't turn things around to make me accountable for their actions or anyone elses. So don't blame Bruce for what someone else may do or believe is right.

Mr.Court did nothing wrong and just because you don't like him and he happens to know someone; it is not right to blame Bruce his brother his family or the LNG group. Yes we don't expect to get respect from the Irvings they want people to shut up and give our rights to speakup easily. We don't have a paper or radio channel or TV to spin another side of what is going on. Thank you CFBC!

No matter what we must hold true to ourselves we can't change people who want to have a close mind and believe the crap printed. Most of us understand so that is what counts and someday we will all be judged by the higher power; not all believe in god and we try to not judge them.

Thank you to all we try to bring fairness to all and that would include Mr.Court and Brother and some MLAs and yes the LNG group and pipeline friends. Sit back and make judgement and go on doing nothing if that is what some of you do; yes some of you think my world is good, who cares about anyone elses life-- glad we do have people who do care and try to make a differnce! THANKYOU AND DON'T GIVE UP; NOTHING GOOD WAS EVER EASY!

If I was Mr. Irving I would think twice about this lawsuit! I don't know who advised him on this one but he better get another opinion.

The very things he claims this protestor has done to infringe upon his right to peaceful enjoyment of his property can be used by the citizens of Champlain Heights, Forest Hills etc, living under the plume of the Refinery to haul his As* into court!

Drive up Grandview Ave. and through Champlain Heights and take a good deep breath and tell me how anyone could enjoy their property!

It should be interesting to see how this one plays out. It will probably be settled out of court!

Nope, no Irving employee here. But in all seriousness Charles, be careful. You might see the Court brothers as all that is good and great about Saint John, but you don't have to ask around too much in Saint John to realize they ain't exactly seen that way by most. It would be a huge mistake for the Liberals to have them on the team for the election. While it might make sense on the surface, I guarantee Graham would live to regret. They'd never follow Graham -- or anybody's -- leadership.

If Irving want to sue someone who does something wrong; sue the person who did it not a group. We all have our own minds are accountable; so the same may happen to Irving if he cost NB the millions lost with the Orimulsion Deal and any Deal that is illegal. Lord should be accountable too. Funny when the taxpayers lose billions through out the years and so much more but yes hang a person for something that can easliy be solved. These major problems with the pipeline and tax deals. Look into my eyes things are serious and will effect all of us for decades. Let the police deal with the smaller things because while we harp on that they sneak something else by us.

Back to saying you don't someone; a good example is our Myor I really know him. Shook his hand, wrote letters, called his phone but I can still say I don't him and happy to see him go. Have an open mind for once; we all deserves to speak up we don't have many rights left. The Mayor doesnot return calls and yet some get calls returned look at the whole picture not the garbage in an Irving written paper which does not always cover the truth.

Too bad it wasn't a better Ragg Paper that it use to be now they are racists, bigots abd slanders at their finest. The Irving paper does not remain objective and spin stories to destroy peoples character. You can't change peoples mind after an untrue fact gets in the paper because people are gullible and any retraction is never read or not believe because people tend to like gossip and love to hear bad about people. Just how you go about defending yourself against this proganda! No one can because they drag things out and it will cost you big bucks and the Irving have of the money.

Respect the Irvings had from me is long gone and respect is something that they must earn. They have no intention of worrying about our respect. They have money and get away with the law and have laws adjusted whenever the system allows big corporations deals at the cost of the rest of us. Think out of the box and sit down really look into the big picture and clarity will happen.

Just look at the NB Power Fiasco and you will see Irving in the middle of all of this and they do not come up innocent.

This is the very first time, I've left a message on this site.

I live in the North End of Saint John.

It's one thing to complain, voice a complaint or a Concern about any Issue or issues.

But I have to honestly say and state, I was shocked to see somebody with the LNG Group was caught dumping stuff at the Residence of one of the Irvings.

This act has gone beyond freedom of Speech, and is Vandalism, nothing less.

I have always been a Liberal Party Supporter,. If Mr. Court is allowed to even run for the North End Riding, I'll be severing all Ties with the Big Red Machine.

Vandalism goes beyond Freedom Of Speech. That was not right, and 2 or 3 Wrongs don't justify anything or an Issue

Here we go again blaming a group it is not the group; I belong to the Coop and if I dump garbage the Coop is not to blame. You work for a company and you do somethibg wrong you are made accountable. We have to open up our minds and oh yes it's my first time on the Blog too; give us break!

Blame is one thing; slander is another and the Irvings can sue the person responsible not you or me or the neighbour.

Why do people have to blame good people who try to have fairness and question what is happening in our city?

It takes a big person to try to put the blame on someone who did nothing wrong but thank you for feeling it is your responsiblity to do police work. Leave the law with them. Words hurt innocent people but the garbage dumped is wrong so stop blaming the rest of Saint John and the group or the Courts. Why not questions your actions of slander.

This group will never go away...every instance the City raises the tax rates every year for the last 20 years?

It will cause an uproar in the City therefore bringing back people together.

The Irvings must announce a news confernce and admit they took advantage of a weak Mayor so therefore we wish to negotiate a better deal.

I'm typing without my glasses so I don't know how this will turn out?

Yes it is not to late to do the right thing and step up and pay some attention to our city, our mayor and councillors. Billionaires who have received every deal from water,power,fuel,land, forests, grants, tax concessions, subsidizes, behind closed doors, in the secret meetings. Please the people here are running of money to pay for all these deals.

Harbour clean up should receive some millions from the Irving Empire who will continually be dumping in our water. We will never have clean water because it would mean for Irving to pay their share and that has never happen. Quality of life does not happen in this area. Money will fly when election times comes again. We need good men to spend the money in the right areas and stop these political games. Our money should be spent to help us prosper not take us down. As it is now we won't be able to live here soon.
